KISS Confetti Blamed for Security Guard’s Tumble

A security guard working at a KISS concert fell after the band “foolishly” sprayed the stage with water and confetti, the guard says in a lawsuit.
Timothy Funk says he worked security at the Klipsch Music Center in Noblesville, Ind. in 2012, and was injured after falling on the “slippery, waxy, and glassy” stage.
Noblesville is the county seat of Hamilton County, located north of Indianapolis.
According to Funk’s lawsuit, “some or all of the defendants” sprayed water from hoses “on the stage, the area around the stage, and on some of the crowd.” They also sprayed confetti around the stage and crowd “in a foolish and reckless manner,” Funk claimed.
The Hamilton Superior Court lawsuit names as defendants the concert venue, Live Nation World Wide Inc., KISS vocalist/bassist Gene Simmons and his associated company.
Funk seeks damages for his injuries, loss of wages, and other unspecified damages. He is represented by Steven C. Smith of Smith Carrillo & Reeder in Anderson, Indiana.
